2. Susan Oubari

Originally from the United States, Susan Oubari worked in the fashion industry (Italian Vogue, Harper's Bazaar, Fashion TV, etc.) for 27 years before leaving this industry to devote herself solely to the practice of her teaching. In the middle of her career, she discovered Reiki, which was a revelation for her; the pillar that allowed her to resist the stressful rhythm of her career. She trained for 14 years with experts such as Nita Mocanu, Philippe Coffin & Colleen Benelli. She then became a Reiki master, and she is certified Usui / Holy Fire® II, Karuna Reiki® Master Teacher, and a professional member of the International Center for Reiki Training. Her discovery of Breathwork came later in Los Angeles in 2017. There she completed a Two-Step Pranayama Breathwork training with Jon Paul Crimi. She perfected her learning with Dan Brulé, one of the pioneers of Breathwork. Fascinated by this still little-known technique, she set herself the challenge of bringing it to France. Today, she is recognized as the pioneer of Breathwork in France with numerous publications in the international press (Vogue, Le Figaro, L'Express, The New York Times, Marie Claire, Elle, etc.). Her individual and group sessions, in Paris and online, as well as her personal development workshops for companies and organizations, are in high demand.

She is the co-author with Emilie Veyretout of the book “Breathwork, Respirez pour changer” (Flammarion, 2020). 

Susan Oubari founded The Breathe in Paris School in 2021 with the aim of training others to become Breathwork facilitators and to spread her unique approach. During this 100-hour immersive Level 1 training - taught in either French or English – Susan Oubari combines her personal life experiences with the tools of her Breathe in Paris Method.

3. Use of the Website

Your use of the Website can only be for lawful purposes and shall, therefore, comply with all applicable laws and regulations. In particular, You will be liable for providing incorrect, false, or third-party information or data (without the third party’s consent) and for any improper use of such information or data.

Susan Oubari shall not be responsible for any damage resulting from the inaccessibility of the Website, or caused by viruses, corrupted files, errors, omissions, service interruptions, deletions of content, problems with the network, providers, or telephone and/or data transmission connections, unauthorized access, data modifications, failures and/or malfunctions of Your electronic equipment.

You hereby acknowledge that You are solely responsible for the compatibility of Your hardware, programs, and software, and Your Internet network with the Website. 

Moreover, Susan Oubari may not be held responsible for any difficulties in accessing the Website or for any temporary interruptions in the access thereto due to maintenance, disruptions of the telecommunications network, or the actions of a third party.

4. Products and Services

- Reiki and Breathwork

By the present Terms and Conditions, the User understands that:

  • Reiki is a simple, gentle, and manual energy technique used to reduce stress and promote relaxation; 

  • Reiki and Breathwork practitioners (including Susan Oubari) do not make any diagnoses, prescribe any substances, perform any medical treatments, or interfere with treatment by a licensed medical professional; 

  • Reiki and Breathwork are not a substitute for medical care or psychotherapy; 

  • It is always recommended that You consult with a physician before accessing the Services and consequently the practice of Reiki and Breathwork, in order to identify any possible contraindications. 

- Products and Services

The User is presented with the essential characteristics of the Products and Services offered by Susan Oubari on the susanoubari.com Website, particularly in the category entitled "SERVICES": 

The User acknowledges having read these characteristics before any purchase of one or more Products and/or Services offered by Susan Oubari. 

- The Breathe in Paris School 

The User understands that the present Terms and Conditions do not govern the services offered by Susan Oubari as part of the program entitled The Breathe in Paris School, which are governed by separate terms and conditions. 

- Price 

The Products and Services offered by Susan Oubari are provided at the rates in effect on the susanoubari.com Website at the time of confirmation of the order of the Product and/or Service (the "Price"). 

The Price is stated in euros including all taxes. 

Susan Oubari reserves the right to modify the Price at any time. The Price applicable to the User shall be the one in effect on the day of confirmation of the User’s order. 

Following the order, Susan Oubari shall draw up an invoice and send it to the User. 

- Payment 

Susan Oubari offers credit card payment via Stripe, which means the User is then subject to Stripe's terms and conditions. Susan Oubari processes payment information online for each order but does not store payment information on her own servers. Your payment information is provided and processed securely via our e-commerce provider which is connected to the Stripe payment provider. 

All personal information collected in connection with an order is used exclusively for the purpose of the performance of that order and the subsequent management of our client relationship with You.

Payments for online classes or webinars are processed by Fastspring whose terms and conditions are available here: https://fastspring.com/legal/terms-sale/ If You do not agree for Fastspring to process your payment, please refrain from purchasing our Products and Services as no other payment method is available to purchase our online classes and webinars.

Any payment made by the User shall be considered final only after collection of the sums due by Susan Oubari.

- Reservation of a class and purchase of a Product (Replay, Meditation)

For the User to book a class or purchase a Product (Replay or Meditation session), we use the ACUITY SCHEDULING platform. By booking a class or purchasing a Product through this platform, the User agrees to comply with the terms and conditions and the privacy policy of ACUITY SCHEDULING available at the following addresses: https://acuityscheduling.com/tos.php and https://acuityscheduling.com/privacy.php

- Cancellation and refund policy

- “Breathe in Paris” group class 

  • Early cancellation of a group in-person class : The User can cancel up to 48 hours prior to the start of a class and receive a full refund or use their payment towards a future class. This cancellation must be made by notifying Susan Oubari by text message, email, or phone. 
    The cancellation will be effective as of the receipt by the User of the confirmation of its cancellation by Mrs. Susan Oubari. 
    In this case, the cancellation of the class will result in the refund of any amount paid by You within fourteen (14) days of the notice of cancellation.

  • Late cancellation of an in-person class : In case of cancellation less than 48 hours before a class, the User understands that the class will not be refunded. The User agrees to inform Susan Oubari by text message, email, or phone so that their place can be assigned to another User on the waiting list. 

  • Absence from a in-person class without prior cancellation : In case of failure to attend a in-person class , the User understands that the class will not be refunded. 

  • There are no refunds for group courses via Zoom.

  • Cancellation by Susan Oubari : Susan Oubari reserves the right to cancel a class and will give reasonable notice. The cancellation of the class will result in the refund of any amount paid by You within fourteen (14) days of the notice of cancellation. 

- Private Sessions 

  • In the event of cancellation of a Private Session, We ask that You notify Susan Oubari at least twenty-four (24) hours in advance (by e-mail, text message, or phone call). In such a case, the cancellation of the class will result in the refund of any amount paid by You within fourteen (14) days of the notice of cancellation. 
    Otherwise, You acknowledge that the session will be due in full and that no refund will be made.

5. Pre-contractual Information - User Acceptance - Legal Guarantees

The User acknowledges having been informed in a legible and comprehensible manner, prior to making the order, of the Terms and Conditions and of all the information required by law, including that provided by Articles L.111-1 and L.221.5 of the French Consumer Code, and particularly of the following information: 

- The essential characteristics of the Products and Services

- The price of the Products and Services

- In the absence of immediate performance of the contract, the date on which or the period within which Susan Oubari undertakes to provide the Products and/or Services ordered

- Information concerning the legal and contractual guarantees and the process for their enforcement (legal guarantee of conformity or hidden defects etc.)

- The possibility of contractual mediation in the event of a dispute

- Information on the right of withdrawal (existence, conditions, time limit, process for exercising this right, and standard withdrawal form)

- Accepted means of payment

User’s order of any Product(s) and/or Service(s) proposed by Susan Oubari implies the User’s full and complete acceptance of the provisions of the Terms and Conditions and of the obligation to pay for the order. 

Susan Oubari guarantees the User against any non-compliance or latent defect affecting the Products and/or Services she offers. 

To claim this guarantee, the User shall inform Susan Oubari in writing of the existence of a non‑compliance or defect within at most one week from the delivery of the Products and/or Services. 

Susan Oubari will refund, correct, or cause to be corrected (to the extent possible) any Products found to be defective as soon as possible and at most within 30 days of Susan Oubari’s having ascertained the non-compliance/defect. 

The guarantee is limited to a refund for the Products and/or Services actually paid for by the User.

6. Right of Withdrawal

You have a right of withdrawal in accordance with the provisions of Articles L.221-18 et seq. of the French Consumer Code, which You may exercise without having to justify Your decision, provided You do so within fourteen (14) days of Your acceptance of the contract, which is the date of receipt of Your Order. 

To make such a withdrawal request, send Your decision to withdraw by any means before the expiration of the above-mentioned fourteen (14) day period, either:

Susan Oubari will then send You an acknowledgment of receipt of the withdrawal. 

When the above-mentioned period of fourteen (14) days expires on a Saturday, a Sunday, or a public holiday in France, it will be extended to the next working day.

In the event of the exercise of the right of withdrawal within the above-mentioned time period, the price of the order placed by the User will be fully refunded within fourteen (14) days from Susan Oubari’s receipt of the notification of withdrawal sent by the User. 

7. Personal Data et Privacy Policy

In the context of the Services offered on the susanoubari.com website, Susan Oubari, in her capacity as data controller, may have to collect Your personal data.

By accepting these Terms and Conditions, You also expressly consent to the possible processing of Your personal data for the purpose of the performance hereof.

Susan Oubari undertakes to comply with all the obligations imposed on her by the GDPR and the modified French Data Protection Act, with respect to the personal data that You provide in the context of Your use of the susanoubari.com website, or during Your registration for the proposed Services. 

In addition, and in compliance with the applicable regulations on telephone canvassing, if You are registered on the Bloctel list, Susan Oubari will not contact You by telephone, except when such contact is necessary for the performance of Susan Oubari's contractual obligations.

We hereby inform You that the personal data collected for the purpose of the performance of the present Terms and Conditions will be kept for a period of 24 months, with the exception of personal data for billing purposes which must be kept for a period of 10 years.

8. Intellectual Property Rights

Susan Oubari owns the French trademarks SUSAN OUBARI and BREATHE IN PARIS BY SUSAN OUBARI filed on 26 January 2021 and registered under numbers 4725695 and 4725702 for goods and services in classes 3, 4, 14, 16, 18, 24, 25, 27, 28, 35, 39, 41, and 44 (hereinafter the "Trademarks"). 

Any reproduction of the Trademarks in whole or in part without the express permission of Susan Oubari is prohibited. 

10. Testimonials

Susan Oubari uses testimonials on the susanoubari.com website.

Prior to their publication on the susanoubari.com website and in accordance with the regulations applicable to fraudulent practices on the Internet, Susan Oubari takes all necessary measures to verify the authenticity of the testimonials.

She personally sees to it that the testimonials are checked before publication, and she verifies that the individuals in question have given their free and informed consent.

The personal experiences provided by former users and reproduced on the susanoubari.com Website do not constitute a guarantee of the results that could be expected from the Products and/or Services. 

11. Civil Liability Insurance

Susan Oubari's civil liability is covered by policy no. 4812412404 taken out with the Axa France insurance company - 313 Terrasses de l’Arche - 92727 Nanterre -Cedex.

13. Force Majeure

Neither Party will be liable to the other for any breach of any obligation under any agreement when it is due to an event beyond that Party's control, including, but not limited to, any act of God, terrorism, war, political insurrection, riot, civil disturbance, act of civil or military authority, uprising, earthquake, flood, or any other natural or man-made contingency beyond our control, which results in the termination of any agreement or contract entered into, and which could not have been reasonably foreseen. Any party affected by such an event shall immediately notify the other party and shall use reasonable efforts to comply with the terms and conditions of any agreement contained herein.

14. Miscellaneous - Applicable Law and Dispute Resolution

Should Susan Oubari temporarily not enforce any provision of the present Terms and Conditions, this shall not be construed as a waiver of her rights under the relevant clause. All the provisions of the present Terms and Conditions shall continue in full force and effect unless expressly stated otherwise in writing by Susan Oubari. 

In the event of a claim that is not resolved directly with Susan Oubari, You may contact a consumer mediator designated by Susan Oubari, in accordance with Articles L.616-1 and R.616-1 of the French Consumer Code.

The chosen mediation entity is: SAS CNPM - Médiation - Consommation. In the event of a dispute, the consumer can file a claim either:

The present Terms and Conditions are governed by the laws of France. Any dispute arising in connection with the interpretation, performance, or termination of this agreement shall be brought before the courts of competent jurisdiction in accordance with the rules of French law. 

If You are acting not as a consumer, but as a business person, the Paris Courts shall have jurisdiction. 

If any provision of these Terms and Conditions is found by a court to be invalid or unenforceable, the remaining provisions of these Terms and Conditions shall remain in full force and effect. 

These Terms and Conditions constitute the entire contractual agreement between You and Susan Oubari with respect to Your use of the Website and/or the Products and/or Services. As such, the Terms and Conditions supersede any prior agreements. 

In case of disagreement on the interpretation these Terms and Conditions, the French version shall prevail over any translation.
